These Terms of Service (“Terms”) govern your use of the eidolonhub.com website and the Eidolon Home AI software products sold by Blacknode Ltd (“we”, “us”, “our”). By purchasing or using our products, you agree to these Terms.

1. Products and licensing
Eidolon Home AI products are digital software sold under a perpetual, non-exclusive, non-transferable license. When you purchase a product, you receive a license to install and use the software on the number of machines specified by your license type.
Standard license: Installation on 1 physical machine
Kickstarter backer license: Installation on up to 5 physical machines
Each installation is tied to a hardware fingerprint generated from your physical machine. You may remove a machine from your account dashboard to free up a license slot for a different machine.

2. Virtual machines and emulation
Eidolon Home AI is designed to run on physical hardware only. Installation and activation on virtual machines (VMs), emulators, containerised environments, or cloud-hosted instances is not supported and is not permitted under this license.
The hardware fingerprint system requires identifiable physical hardware to function correctly. Attempting to activate the software on a virtual or emulated environment may result in activation failure and will not be considered a technical defect eligible for a refund.

3. Permitted use
You may:
Use the software for personal, educational, or commercial purposes
Generate content (text, images, video, music, documents) using the software for any lawful purpose
Install updates provided through your account dashboard
Use the software on the number of machines permitted by your license
You may not:
Redistribute, resell, sublicense, or share the software or your license key with any third party
Reverse engineer, decompile, disassemble, or attempt to extract the source code
Circumvent, disable, or tamper with the license activation or hardware fingerprint system
Use the software for any unlawful purpose
Activate the software on virtual machines, emulators, or cloud instances

4. Content ownership
Content you create using Eidolon Home AI — including conversations, images, videos, music, and documents — belongs to you. Blacknode Ltd claims no ownership or rights over content generated by the software running on your hardware.
The underlying AI models are used under their respective open-source licenses (MIT, Apache 2.0, or similar). Your ownership of generated content is subject to any restrictions imposed by those model licenses.

5. Software updates
Your license includes access to updates within the same major version of the software (e.g. v1.x updates are included with a v1 license). Major version upgrades (e.g. v1 to v2) may be offered at a discounted upgrade price and are not guaranteed to be free.

6. Payment and pricing
All prices are listed in British Pounds (GBP). Payment is processed securely through Stripe. Prices shown are inclusive of any applicable taxes.

8. Disclaimers and limitation of liability
The software is provided “as is” without warranty of any kind, express or implied. We do not warrant that the software will be error-free, uninterrupted, or compatible with all hardware configurations.
Eidolon Medical disclaimer: The Eidolon Medical module is an AI assistant for informational purposes only. It is not a certified medical device, not a diagnostic tool, and must not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider for medical decisions.
AI-generated content disclaimer: AI models may produce inaccurate, incomplete, or misleading information. Always verify important information from authoritative sources. Blacknode Ltd is not responsible for decisions made based on AI-generated content.
To the maximum extent permitted by applicable law, Blacknode Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software or reliance on AI-generated content.

9. Intellectual property
The Eidolon Home AI software, including all code, documentation, branding, interface design, and installer components, is the intellectual property of Blacknode Ltd, protected by copyright law.
The underlying AI models are used under their respective open-source licenses. Your license grants you the right to use the software as described in these Terms — not to own, copy, or redistribute it.

10. Account and license termination
We reserve the right to suspend or terminate your license and account if you:
Share your license key with third parties
Distribute or redistribute the software
Circumvent or tamper with the license activation system
Activate the software on virtual machines or emulated environments
Violate any other provision of these Terms
In the event of termination for cause, no refund will be issued.

11. Installer and activation
By running the Eidolon installer, you confirm that you have read and accepted these Terms of Service. The installer will display a summary of these Terms and require explicit acceptance before proceeding with installation.

12. Changes to these Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of our products and services after changes constitutes acceptance of the revised Terms.

13. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms or your use of our products shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in the EU, you may also have the right to bring proceedings in the courts of your country of residence under applicable EU consumer protection law.
